Ad Quality Policy

Pubphirst, hereinafter referred to as "Pubphirst" requires that all advertisements delivered via our platform adhere to quality criteria aimed at preserving the user experience and fulfilling the stipulations set forth by our inventory partners.

By engaging with the "Pubphirst" platform and utilizing its services, each Advertiser/Demand Partner acknowledges and agrees to comply with the Policies outlined herein. These Policies, which may undergo revisions, will be communicated through our website or other suitable means. Henceforth, these Advertisers/Demand partners will be referred to as “Buyers/Buyer”. Buyers are solely responsible for remaining informed about any changes or updates to these Policies. It is important to note that "Pubphirst" retains full discretion in implementing and enforcing these Policies.

General Policies

When utilizing "Pubphirst"’s services and placing ads, buyers must adhere to all applicable laws, regulations, and self-regulatory guidelines in the relevant jurisdiction. This includes compliance with laws regarding the placement of ads through online behavioral advertising, as well as the delivery of ads to children. Buyers must abide by the Digital Advertising Alliance (DAA) Self-Regulatory Principles, referred to as the “DAA Principles”, the IAB Europe EU Framework for Online Behavioral Advertising and EASA Best Practice Recommendation on Online Behavioral Advertising, which is overseen by the European Interactive Digital Advertising Alliance.

Buyers are obligated to ensure that consumers are well-informed about their privacy practices. Advertisers who employ behavioral advertising must offer consumers a way to opt out of such targeted ads. Moreover, buyers are required to honor user opt out choices.

Buyers are expected to adhere to the Better Ads Standards established by the Coalition for Better Ads – https://www.betterads.org/standards/. Additionally, it is essential for buyers to avoid utilizing “least preferred ad experiences” as outlined by these standards.

Ad Content, Type and Behaviour Policies

Ad and Landing Page Content Policies

  • Adult Content: Ads must not contain or promote nudity, sexual content, pornographic material, or explicit adult language in either the ad itself or the associated landing page.
  • Offensive Language: Advertisements should refrain from using explicit adult language that may be deemed offensive or inappropriate for general audiences.
  • Tobacco and Related Products: Ads must not promote or advertise tobacco products, including cigarettes, cigars, or other tobacco-related paraphernalia.
  • Firearms and Weapons: Advertisements must not encourage or endorse the sale, purchase, or use of firearms, ammunition, or any other weapons.
  • Hazardous Substances: Ads should not promote or advertise hazardous substances that may pose a risk to public health or safety.
  • Illegal Drugs: Ads must not promote or facilitate the use, sale, or distribution of illegal drugs or controlled substances.
  • Shocking Content: No provocative images, shocking content; graphic or explicit violence.
  • Illegal Activity or Harmful activity: Ads must not promote or provide instructions, guidance, or information on engaging in illicit or harmful activities, including but not limited to bomb-making, lock-picking, or similar topics.
  • Death, Injury, or Gory Content: Ads must not contain or depict content that involves explicit depictions of death, injury, or gory imagery that may be distressing or disturbing to viewers.
  • Cannabis Ads: Cannabis ads will be evaluated on a case-by-case basis, ensuring compliance with regulatory and geographic guidelines. Ads containing illegal cannabis-related promotional content, such as appealing to children or making health claims, are prohibited.
  • Gambling: Ads promoting gambling, both online and offline, are prohibited.
  • Online Piracy: Ads must not encourage or promote online piracy, copyright infringement, or the sale of counterfeit products. Ads must not promote file-sharing or torrent sites.
  • Violation of Laws: Ads must not violate any applicable law, regulation, governmental rule, or court order, or contain content that is otherwise harmful or illegal.

Same policies apply to the landing pages.

Ad and Landing Page Behavior Policy

  • • No initiated downloads without user consent.
  • • No automatic redirects to new pages or apps.
  • • No auto-play audio in display ads.
  • • No imitation of system errors or deception.
  • • Auto-refresh functionality is not allowed.
  • • Pop-ups and Pop-unders are prohibited.
  • • No deceptive practices to mislead clicks.
  • • User action required for SMS or charges.
  • • Browser navigation must remain functional.
  • • No distribution of malware/spyware/viruses.
  • • No phishing or misrepresentation.
  • • Max fully loaded size of 800kb.

Buyers are responsible for ensuring compliance with the restrictions related to creative content and formats as communicated in bid requests, including specifications such as openRTB’s badv (Blocked advertisers) and battr (Blocked creative attributes).

Same policies apply to the landing pages.

The onus is on the Buyer for complying with Children’s Online Privacy Protection Rule (COPPA) and California Business and Professions Code Section 22580 (“BPC 22580”) regulations based on relevant flags transmitted in bid requests.

Buyer shall defend, indemnify and hold harmless "Pubphirst" and its affiliates, and each of their officers, directors, employees and agents (each an “Indemnified Party”) from all third party claims and liabilities (including reasonable attorney’s fees and legal costs) arising from or relating to (a) any violation of this Ad Quality Policy by Buyer (even if an exception has been granted), (b) any violation of applicable laws, rules, or regulations (even if an exception has been granted), or (c) any infringement or misappropriation of any intellectual property right of a third party (even if an exception has been granted).

At its sole discretion, "Pubphirst" has the right to temporarily pause or terminate any ad campaign or Buyer found in violation of these policies at any time. Ad campaigns may not commence until "Pubphirst" is satisfied that the policy violation is no longer present. Additionally, "Pubphirst" reserves the right to reject, suspend, or remove any Buyer from its platforms. These policies do not impose any limitations on "Pubphirst"’s discretion.
